The petitioner apprehends his arrest in a case registered for the offence under Sections 272, 273, 414, 34 of the I.P.C. and Section 30(a) of Bihar Prohibition and Excise Act. 1440 liters of Nepali country-made liquor has been recovered from a pick-up van.

It is submitted on behalf of petitioner that petitioner is neither owner nor driver of the said vehicle and has got no concern with the seized liquor. Nothing has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent.

Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the

Patna High Court CR. MISC. No.56550 of 2022(2) dt.02-12-2022 2/2 event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge, Excise Act, Madhubani in connection with Madhawapur P.S. Case No. 74 of 2022 (G.R. No. 889 of 2022), subject to conditions as laid down under Section 438(2) of the Cr.P.C.
