Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 325, 307/34 and 302 of the Indian Penal Code. The petitioner and two others had assaulted with lathi and iron rod to Sant Lal Sah on 30.07.2017. Sant Lal Sah died on 18.08.2017 during course of treatment. The Doctor had found head injury on the person of the deceased.

This Court had refused prayer for bail to the petitioner on 28.03.2018 vide order at Annexure-1 with liberty to renew the prayer after framing of the charge.

Petitioner is in custody since 02.08.2017.

Patna High Court Cr.Misc. No.54552 of 2018(3) dt.12-12-2018 2/2 Report of the learned Trial Judge would reveal that charges have already been framed. Learned counsel for the informant opposed the prayer for bail.

Considering the period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No.370 of 2018 arising out of Kangali Police Station Case No.47 of 2017, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
