JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366, 366A/34 of the Indian Penal Code.

The statement of victim was recorded under Section 164 of the Cr.P.C. in which she stated that she had left her home voluntarily and when she got information about the institution of the present case, she returned and got recorded her statement. She further stated that she has already solemnized her marriage with petitioner. The victim disclosed her age as 18 years though she was found aged about 17 years in medical examination.

No.25160 of 2016 (3) dt.22-06-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bihar P.S. Case No. 59 of 2016.
