18-06-2015 Heard Sri Ram Sumiran Rai, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Pakribarawan P.S. Case No. 164 of 2014 registered for the offence under Sections 25(1-B)A and 26 of the Arms Act, 1959, has prayed for grant of anticipatory bail.

Learned counsel for the petitioner submits that prior to lodging of the present F.I.R., one another F.I.R. was lodged against the petitioner, vide Pakribarawan P.S. Case No. 161 of 2014. He submits that though the petitioner was made accused in Pakaribarawan P.S. Case No. 161 of 2014, finally, police submitted final report, however; on false accusation, the petitioner has been made accused in the present case. Nothing has been

Patna High Court Cr.Misc. No.20025 of 2015 (2) dt.18-06-2015 2/2 recovered from the possession of the petitioner. In view of the facts and circumstances, the Court considers that it is a fit case for extending the privilege of anticipatory bail.

Accordingly, in the event of his arrest or surrender before the court below within a period of one month from today let the petitioner namely Kaushlendar Mahto be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Nawada in connection with Pakribarawan P.S. Case No. 164 of 2014, subject to condition laid down under Section 438(2) of the Cr.P.C.
