The petitioner is accused in connection with Sabour P.S. Case No. 239 of 2018 registered under Section 394 of the Indian Penal Code.

The accusation is that informant, Dilip Kumar, along with Khalasi, Kari Kumari, proceeded with truck loaded with stone chips but in the way, four persons stopped the truck and sat on the the truck and on the point of pistol, informant and Khalasi were removed from the truck snatching cash and mobile set. At that time, informant and Khalasi were injected the medicines, in which, both become unconscious. In the meantime, they were talking to each other denoting their names as Guddu, Piyus (petitioner) and Mukesh. Learned counsel for the petitioner submits that after

Patna High Court CR. MISC. No.56688 of 2019(3) dt.04-12-2019 2/2 lodging the present case, petitioner was apprehended and remanded in the present case and thereafter, petitioner was also remanded in Jagdishpur P.S. Case No. 377 of 2018, which was lodged in respect to recovery of robbed truck of the present case. It is further submitted that petitioner has no criminal antecedent and is in custody since 24.08.2018 and the charge sheet has already been submitted against the petitioner. It is further submitted that similarly situated coaccused, Mukesh Kumar, has already been granted privilege of bail by this Court vide order dated 26.09.2019 passed in Criminal Misc. No. 40262 of 2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., XIII, Bhagalpur, in connection with Sabour P.S. Case No. 239 of 2018. Out of two sureties, one surety must be the close relative of the petitioner.
