JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2018 The petitioner seeks regular bail in connection with Hussainganj (M.H. Nagar) P.S. Case No. 213 of 2016, registered for offences punishable under Section 392 of the Indian Penal Code.

Allegation as per F.I.R. some miscreants snatched away apache motorcycle of the petitioner and Rs. 40,000/- and a bag containing 20 mobile phones.

It has been submitted on behalf of the petitioner that he is not named in the F.I.R. and save and except confessional statement of the co-accused, there is nothing against him and no Test Identification Parade has been conducted and petitioner has been in judicial custody since 03.02.2017 and though he is accused in four other cases but in all those cases,

Patna High Court Cr.Misc. No.55619 of 2018(4) dt.06-11-2018 2/2 he is on bail.

Having heard both sides, considering the facts and circumstances of the case and also the period of custody of the petitioner, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Hussainganj (M.H. Nagar) P.S. Case No. 213 of 2016, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
