The petitioner seeks bail in Ram Nagar P.S. Case No. 212 of 2021, registered for the offence punishable under Sections 302, 34, 120(B) of the Indian Penal Code and section 27 of the Arms Act.

As per the FIR, on 25.06.2021 son of informant along with his co-worker Nashim Khan and Guddu Mian left for Narkatiyaganj. On the same day informant got information at about 8.20 pm that his son has been murdered by knife and pistol by three accused persons boarded on Apache motorcycle. Informant along with family members took her son to the hospital for treatment who during course of treatment died. It is further alleged that two persons boarded on his motorcycle and

Patna High Court CR. MISC. No.67548 of 2021(2) dt.28-02-2022 2/2 three unknown persons committed murder of her son. She raised suspicion against Jakir Hussain, Afjal, Gajala Khatoon and Maimullah for murder of her son.

It is submitted on behalf of the petitioner that petitioner is neither named in the FIR nor named in the restatement of informant. During course of investigation, informant raised suspicion against this petitioner on the ground that some days prior to the occurrence there was dispute between the petitioner and the deceased. Save and except suspicion there is no material against this petitioner. Petitioner claims clean antecedent and he is in custody since 29.08.2021. Investigation is complete.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Bagaha, West Champaran in connection with Ram Nagar P.S. Case No. 212 of 2021.
