The petitioner is apprehending arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

The accusation is of committing 'dacoity' in the house of the informant and the name of petitioner sprang up on the confession of co-accused.

It is submitted by learned counsel for the petitioner that neither any recovery has been made from the petitioner nor the petitioner was put on Test Identification Parade, a statement to this effect has been made at paragraph 7 of the petition. The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Patna High Court Cr.Misc. No.20221 of 2015 (2) dt.30-04-2015 2/2 Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Mehsi P.S. Case No.144 of 2012, pending before the learned Chief Judicial Magistrate, East Champaran at Motihari.

With the above observation, this application is, accordingly, disposed off.
