JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-12-2021 Heard learned counsel for the petitioner and the State. Earlier prayer for bail of the petitioner was refused by this Court vide order dated 20.5.2021.

It is submitted by learned counsel for the petitioner that similarly situated co-accused Jitendra Mali against whom also there was allegation of assault by the butt of gun, has already been allowed bail by a co-ordinate bench of this Court vide order dated 25.10.2021 (Annexure 3A). Petitioner is in custody since 16.7.2020.

Considering the fact that similarly situated co-accused has already been allowed bail by a co-ordinate bench of this Court, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the

Patna High Court CR. MISC. No.67900 of 2021(3) dt.22-12-2021 2/2 like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram in Nokha Police Station Case No. 46 of 2020.
