JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-02-2017 The petitioner is apprehending his arrest in connection with Shambhuganj P.S. Case No. 41 of 2016, registered for offences punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that though there is allegation against the petitioner that he inflicted garasa blow on the informant, however the injuries caused to the informant is found to be simple in nature and the petitioner has no criminal antecedent.
Heard learned A.P.P. also.
Having heard both sides, in view of the fact that the petitioner gave repeated blow by garasa on the informant first causing injury on his neck and another causing injury on knee joint of the informant, as such, I am not inclined to grant the
Patna High Court Cr.Misc. No.7481 of 2017 (2) dt.23-02-2017 2/2 petitioner, the privilege of anticipatory bail, it is accordingly rejected.
Petitioners are directed to surrender before the court below and pray for regular bail and if any such application is filed, the court below shall consider the same and pass an appropriate order without being prejudiced by the order of this Court. (Vinod Kumar Sinha, J) sunil/- U T
