Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.
It would appear from perusal of the first information report that the alleged occurrence took place on account of partition dispute and moreover, the injured appears to have sustained simple injury.
Submission on behalf of the petitioners is that police
Patna High Court Cr.Misc. No.26681 of 2016 (3) dt.22-07-2016 2/2 after due investigation, found the accusation untrue under Section 307 of the Indian Penal Code.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. Case No. 275 of 2016.
