The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act. The informant son of the deceased stated that Sandip Yadav and four others came and made indiscriminate firing on his father consequently his father died on the spot. Name of the petitioner figured in the case in the confessional statement of Vikrama Paswan in para- 36 of the case diary and the petitioner was arrested and he is also said to have confessed his guilt. Save and except confession of the co-accused and the petitioner before the police, the police did not collect any tangible material. Similarly situated co-accused Sanjiv Mishra has already been

Patna High Court Cr.Misc. No.21786 of 2015 (3) dt.08-09-2015 2/2 enlarged on bail vide orders passed in Cr. Misc. No. 9419 of 2015. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in Itarhi P.S. Case No. 236 of 2014.
