ANJANA MISHRA ORAL ORDER 27-09-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Mahua P.S. Case No.110 of 2016 for allegedly having committed the offence under Sections 420 and 120B of the Indian Penal Code and Section 7 of the Essential Commodities Act.

Learned counsel for the petitioner submits that the alleged recovery was made from the possession of Umesh Bhagat and not from this petitioner. It is further submitted that neither the petitioner is a PDS dealer nor he is an agent. It is further submitted that the name of the present petitioner has surfaced on the basis of the confessional statement made by

Patna High Court Cr.Misc. No.32414 of 2016 (2) dt.27-09-2016 2/2 the co-accused Umesh Bhagat before the police, which has no evidentiary value.

In view of such facts and circumstances and as has been submitted by the petitioner that earlier said Umesh Bhagat had roped in the petitioner under similar Section only on account of some electoral dispute, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Mahua P.S. Case No.110 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
