The petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 452, 302 and 201 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 18.01.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case. The learned counsel for the petitioner further submits that the informant alleges that on 01.03.2019 at about 9.00 P.M. while the informant along with his family members were at his house when the petitioner along with other named accused persons came and forcibly took his mother and father in a room and thereafter, it is alleged that all the accused persons assaulted them and later, his mother disappeared.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. The

No.68011 of 2021(2) dt.20-04-2022 2/2 allegations are general and omnibus in nature against all the accused persons including this petitioner and no specific overt act has been attributed to this petitioner. It is further submitted that the informant is not an eye witness to the occurrence and only on the basis of suspicion, the petitioner has been made accused in this case. It is also submitted that there is delay of almost five days in instituting the F.I.R. It is further submitted that co-accused Bijay Das has been granted bail by order dated 24.07.2021 in Cr. Misc. No.20177 of 2021.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in this case and co-accused has been granted bail, the petitioner, abovenamed, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Jagdishpur Gordih P. S. Case No. 75 of 2019.

The application stands allowed.
