JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 1025C of 2017 in which cognizance has been taken under Sections 498A, 494 of the Indian Penal Code and Section 4 of Dowry Prohibition Act, pending in the court of S.D.J.M., Begusarai.

Allegation against the petitioner, who happens to be husband of the complainant, is of demanding dowry and for that torturing her and there is also allegation against him that he solemnized second marriage with another lady. Submission of learned counsel for the petitioner is that earlier also a case has been lodged against the petitioner and

On the other hand, learned counsel for opposite party No.2 has submitted that since petitioner has remarried with another lady the question of her residing with him does not arise and she is ready for one time settlement.

In view of above facts and circumstances, this application is disposed of with direction to the petitioner to surrender in the court below on 14.11.2019, on that day opposite party No.2 shall also remain present in court and petitioner shall be released on provisional bail by the court below itself, who shall refer the matter to the District Mediation Centre where both the parties shall appear for an amicable settlement between them and learned court below after perusing the report of Mediator and also considering the conduct of both the parties shall either confirm the bail bonds of the petitioner or pass an appropriate order as it may deem fit and proper.
