JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-06-2016 Heard learned counsel for the petitioners and learned counsel appearing for the State.

Petitioners apprehend their arrest in connection with Paraiya P.S. Case No. 95 of 2015, registered for the offences punishable under Sections 147, 148, 323, 379, 353, 504 and 506 of the Indian Penal Code.

The accusation against the petitioners is that they assaulted the employees of the Electricity Department and also snatched their belongings when the employees of Electricity Department had gone to repair the electric wire. The contention of the petitioners is that petitioners are local farmers as well as bonafide consumers of Electricity Department and as a matter of fact, the electric supply in the area

Patna High Court Cr.Misc. No.24894 of 2016 (2) dt.16-06-2016 2/2 of the petitioners was not proper and when they made complaint to the Electricity Department, the employees of the Electricity Department came there and asked the petitioners to meet their illegal demand and when the petitioners refused to meet the illegal demands of the employees of the Electricity Department, a hot exchange of words took place between them and after that, the informant lodged this false case against the petitioners. It is further submitted that the petitioners do not have any criminal antecedents and as a matter of fact, there is nothing in the impugned order to show that any employee of the Electricity Department including the informant had sustained any injury in the so-called offence.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Gaya, in Paraiya P.S. Case No. 95 of 2015, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
