The petitioner seeks bail in Pandaul P.S. Case No. 79 of 2018 instituted for the offence under Sections 147, 148, 149, 341, 342, 323, 307, 427, 337, 379, 504 and 506 of the Indian Penal Code.
In the written report it is alleged that petitioner gave Farsa blow on the head of the informant.
Counsel for the informant has appeared and submitted that petitioner entered into the medicine shop of the informant and took money from the cash box (Galla) and assaulted the informant.
Patna High Court Cr.Misc. No.53703 of 2018 (4) dt.29-10-2018 2/2 Counsel for the petitioner submits that Doctor has found only one injury on parietal region measuring 4" x 1⁄4" x 1⁄4. Rest injuries were found to be simple in nature. Case diary has been received. The injury report is available in the case diary from which it appears that there is no repetition of blow.
Petitioner is in custody since 30.06.2018.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani, in connection with Pandaul P.S. Case No. 79 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
