JUSTICE SANJAY PRIYA ORAL ORDER 11-10-2018 Heard learned counsel for the petitioners, informant and the learned A.P.P. for the State.
The petitioners seek bail in Mahishi P.S. Case No. 136/2018, instituted for the offences under Sections 341, 342, 447, 324, 307, 302 and 504/34 of the Indian Penal Code. It is alleged in the written report that Rakesh Kumar Jha always used to tease the informant and also used to call on her mobile. On 01.06.2018, while mother of informant had gone to Tara Asthan Mandir and the informant was alone in the house, accused Rakesh Kumar Jha came with gallon of kerosene oil at 7 A.M. and poured the same on the body of informant and set her on fire. Petitioners were also present there.
Learned counsel for the informant has submitted that
Patna High Court Cr.Misc. No.58290 of 2018 (3) dt.11-10-2018 2/2 in para 8 and 9 of case diary witnesses have taken the name of these petitioners.
From para 8 and 9 of case diary, it appears that witnesses have levelled specific allegation against Rakesh Kumar Jha of pouring kerosene oil and setting the informant on fire. Considering the aforesaid fact and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Saharsa in connection with Mahisi P.S. Case No. 136/2018, subject to the conditions that both the bailors shall be the close relative of the petitioners.
