The petitioner seeks bail in a case registered for the offences punishable under sections 302, 201/34 of the Indian Penal Code.
The father of the deceased made allegation that his daughter Sarita Devi was married with the petitioner in the year 2010 but the petitioner developed illicit relation with the sister-in-law. The accused persons killed his daughter and threw her dead body. The dead body of the deceased was found floating in a river tied in a gunny bag. On perusal of post mortem it transpired that the deceased was strangulated to death. It is submitted that there is no eye witness of the
Patna High Court Cr.Misc. No.21457 of 2015 (3) dt.04-09-2015 occurrence. The trial of the petitioner has already begun and two witnesses including the informant have already been examined. Considering the nature of allegation and the fact that the petitioner is the husband, I am not inclined to enlarge the petitioner on bail in connection with Alipur P.S. Case No. 54 of 2014 giving rise to Sessions Trial No. 63 of 2015/187 of 2015 pending in the court of the learned Additional Sessions Judge VIII, Gaya. His prayer for bail is accordingly rejected. The trial court is directed to expedite the trial and conclude the same within a period of six months from the date of receipt/production of a copy of this order.
