The petitioner apprehends his arrest in Madhepur P.S. case No.58 of 2016 under Section 7 of the E. C. Act. A truck loaded with rice was seized and it is alleged that petitioner was sending rice to Rajasthan for selling. The learned senior counsel for the petitioner submits that petitioner is not a licensee of the P.D. S. shop. The petitioner is a business-man and he purchases the rice and sales the same in open market. There is no control order for purchasing and selling of rice in open market.
Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named
Patna High Court Cr.Misc. No.10482 of 2017 (2) dt.15-03-2017 2/2 petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani in Madhepur P.S. Case No. 58 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
