JUSTICE SUDHIR SINGH ORAL ORDER 02-07-2015 The petitioner is apprehending her arrest in connection with Triveniganj P.S. Case No. 101 of 2014 for the offences instituted under Sections 147, 149, 447, 323, 307 and 504 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 12.06.2014, the petitioner and her family members' total being 10 in numbers armed with lathi, came and assaulted the informant and his family members. They also took away Rs. 35,000/- from possession of the informant. The cause behind the occurrence is alleged to be land dispute.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.20709 of 2015 (2) dt.02-07-2015 petitioner has got no criminal antecedent. It is further submitted that main allegation is against Bachan Bhagat. It is further submitted that there is case and counter case. Counter case is annexure-2 to the present application. Further from perusal of annexure-3 it would appear that the injuries are simple in nature. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the same, the petitioner above named, is directed to be released on bail in the event of her arrest or surrender before the learned court below within a period of four weeks from today in connection with Triveniganj P.S. Case No. 101 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Supaul, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
