Petitioner seeks bail in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.

The statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure would reveal that she had gone along with the petitioner to different places, including from Gaya to Patna and from Patna to Delhi on a train and thereafter to Haryana without making any protest. Submission is that the matter is of previous affairs between the two and under pressure of the parents she has made statement before the Magistrate that she was taken away by the petitioner and others.

No.54828 of 2019(2) dt.05-09-2019 2/2 Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Khizarsarai Police Station Case No.93 of 2019, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
