JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-06-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 47(a) of the Excise Act.
From the house of the petitioner 15 litres of illegal liquor and the materials and equipments for manufacturing the liquor were recovered.
It is submitted by learned counsel for the petitioner that recovery is from the joint family house. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Case No. 5c3Ex of 2016, pending in the Court of learned Additional
Patna High Court Cr.Misc. No.25373 of 2016 (2) dt.22-06-2016 2/2 Chief Judicial Magistrate, 5th, Biharsharif at Nalanda. With the observations above, the application stands disposed off.
