The petitioner seeks bail in Dehri (Indrapuri O.P) P.S. Case No. 348 of 2021, registered for the offence under Sections 341, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, on 30.06.2021 at 5:30 PM, the petitioner alongwith two co-accused persons came at the house of informant and started abusing him and thereafter, it is alleged that co-accused persons tried to fire from his katta, but could not fire and lastly, the accused persons threatened the informant with dire consequences.

It is submitted on behalf of petitioner that petitioner has been falsely implicated by the informant due to old enmity. It is further submitted that petitioner is only alleged to have

Patna High Court CR. MISC. No.68467 of 2021(2) dt.03-03-2022 2/2 abused the informant by waving his gun. In the incident, no one sustained any injury and petitioner is in custody since 21.08.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Dehri-on-Sone, Sasaram, Rohtas in connection with Dehri (Indrapuri O.P) P.S. Case No. 348 of 2021.
