The petitioner prays for anticipatory bail in connection Sahebganj PS case no. 19 of 2012 registered for the offence punishable under various sections 406, 409, 420, 467, 468/34 of Indian Penal Code.

It is submitted on behalf of petitioner that petitioner has been made an accused in this case and the allegation is that an amount of Rs. 1,43,340/- was allotted to the petitioner being Panchayat Secretary for distributing scholarship in the schools and he has not defalcated the same. It has also been submitted that during the course of investigation, it has come that he handed over the money to the

Learned A.P.P. has opposed the prayer for bail and submitted that during enquiry, it has come that he has given less money to the students and taken receipt of the actual amount but he also could not controvert that during investigation, it transpires that Headmasters are mainly responsible. Having heard both sides. In view of the submissions advanced on behalf of parties, let the petitioner, named above, in the event of his arrest or surrender in the Court within a period of two weeks from the date of receipt/ production of a copy of this order, be released on bail on furnishing bail bond of Rs. 25,000/-(Rs.

Twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Sahebganj P.S. case no. 19 of 2012 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that petitioner shall co-operate in the investigation and make himself available before the police as and when required and in the event of failure on his part to appear before the police on two consecutive dates, the prosecution shall be free to move for cancellation of his bail bonds and further petitioner will not induce any witness to tamper with the evidence.
