JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-399, 402, 412, 414/34 of the Indian Penal Code and 25(i-B)A, 26,35 of the Arms Act.

One loaded country-made Katta is said to have been recovered from conscious possession of the petitioner when he along with others had allegedly assembled to make preparation for committing dacoity.

Submission on behalf of petitioner is that co-accused Kanhaiya Kumar Rai and Arman Ali have already been granted privilege of bail and the case of the petitioner is almost on similar footing to that of above-said co-accused. It is further submitted

Patna High Court Cr.Misc. No.24910 of 2016 (3) dt.20-06-2016 2/2 that when the petitioner was arrested in the present case, he was remanded in some other cases also and moreover, petitioner is in jail custody since 14-12-2015.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bhagwanpur Hat P.S.
