The sole petitioner, apprehending his arrest in Lalganj P.S. Case No. 309 of 2017 registered for the offence under Sections 30(a)/ 32(2) / 41(1) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail, in the event of his arrest or surrender.

It was submitted by learned counsel for the petitioner that the petitioner, in the present case, has been made accused on the basis of confessional statement of a driver, otherwise there is no other material against the petitioner. However, on perusal of the statement made in

Patna High Court Cr.Misc. No.54141 of 2018(4) dt.08-10-2018 2/2 paragraph-3 of the petition, it is evident that petitioner appears to be habitual offender. Besides the present case, he has also been made accused in four cases. In such situation, there is no reason to entertain the prayer for grant of anticipatory bail.
