JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-419, 420, 461, 405, 406, 468/34 of the Indian Penal Code.
According to prosecution case itself, the petitioner was neither appointed as agent nor has taken advance amount and in course of inquiry, conducted by Assistant Engineer as well as Junior Engineer, the villagers disclosed the involvement of the petitioner in the present case. The report of Junior Engineer as well as Assistant Engineer does not disclose as to what role had been played by the petitioner in the alleged crime, however, the
Patna High Court Cr.Misc. No.26138 of 2016 (2) dt.05-07-2016 2/2 impugned order of learned Additional Sessions Judge goes to show that the petitioner had played role of middleman in the alleged crime.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Harnaut (Kalyan Bigha) P.S. Case No. 130 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Bihar Sharif, Nalanda.
