The petitioner apprehends his arrest in Baikunthpur P.S. Case No.204 of 2021 registered under Section 307 and other minor sections of the Indian Penal Code as well as Sections 30(a), 41 and 45 of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case merely on the basis of confession made by apprehended accused. It is further submitted that nothing has been recovered from possession of the petitioner. He also submits that the petitioner is not the owner of the vehicle and he has got no concern with the seized lilquor.

No.68017 of 2021(2) dt.29-04-2022 2/2 Having considered the above facts and circumstances of the case, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge -cum-Special Judge, Excise, Gopalganj in connection with Baikunthpur P.S.
