Petitioner is an NRI and she has some dispute with her in-laws and other relatives, for which, she has filed complaint case bearing Complaint Case No. 179 of 2016 which is still pending in the court of learned Chief Judicial Magistrate, Hajipur.

WJC No.571 of 2016 (2) dt.14-06-2016 2/3 Petitioner's husband as well as her children have to visit India on 26-06-2016 but she apprehends threat on their life as her in laws and their supporters had earlier given threatening to kill them and therefore, she wants proper security, so that, she along with her husband and children could visit her matrimonial home.

Learned counsel, appearing for petitioner submits that the petitioner has given several applications for providing security but all went unheard and thereafter, she has approached this court by filing the present Cr. Writ petition. It is further pointed out on behalf of the petitioner that husband and children of the petitioner, has to remain in India from 26-06-2016 to 26-09-2016 and they need security only for three months.

Learned Additional Public Prosecutor Sri Ram Priya Sharan Singh, appearing for the State points out that the pleadings of this writ petition, go to show that the petitioner wants to settle her private dispute but even if, the submission of learned Additional Public Prosecutor is accepted, then also, in my view, the petitioner along with her husband and children need some protection because it has, specifically, been pleaded by the petitioner in her petition that earlier, she has received threatening of dire consequences by her in laws as well as their supporters.

Patna High Court Cr. WJC No.571 of 2016 (2) dt.14-06-2016 3/3 Moreover, the petitioner seeks security only for a limited period and she is ready to pay the cost of aforesaid security. Therefore, in the aforesaid circumstances, this writ petition stands disposed off with direction to the Superintendent of Police, Muzaffarpur (respondent No. 6) to provide a suitable and proper security to the petitioner as well as her husband and children from 26-06-2016 to 26-09-2016 on the cost that shall be charged as per Government rule.
