The petitioner apprehends his arrest in connection with G.R. No.1445 of 2018, arising out of Mufassil P.S. Case No.160 of 2018, registered under Sections 341, 323, 384, 452 and 354/34 of the Indian Penal Code.
The accusation is that on 24.05.2018 at about 08.30 P.M., when the informant Chandan Kumar along with his cousin Rajeev Kumar Singh was returning to his house from the local market, in the way, the petitioner along with other accused, named in the F.I.R., borne on motorcycle, were present. At that time, this petitioner dashed the informant with motorcycle, due to which the informant fell down and, thereafter, this petitioner
Patna High Court CR. MISC. No.55307 of 2019(2) dt.03-09-2019 2/3 slapped the informant on his cheek, saying that as to why he had not paid ransom of Rs.3,00,000/- to him and ordered their associates to kill the informant, who started to cause assault him through legs and fists. On the intervention of his cousin Rajeev Kumar Singh, the informant was set free by them. Thereafter, the informant along with his cousin came to his house. Thereafter, in the night at about 11.30 P.M., all the F.I.R. named accused including the petitioner along with three unknown entered into the house of the informant forcibly. Thereafter, the petitioner and Gaurav Kumar, who were armed with revolver, started to make firing at him but the same passed over through his upper portion as the informant hide himslef. When the mother of the informant rushed there to save him, then the petitioner with an intention to outrage her modesty started pulling her Saree and, thereafter, pointing the pistol on the informant asked him to pay ransom within seven days giving threatening of dire consequences.
Learned counsel for the petitioner submits that the petitioner and the other F.I.R. named accused are the covillagers of the informant and due to dirty village politics, the informant has lodged the present case with false allegation only to put undue pressure upon them. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri N.K. Ram, the Chief Judicial Magistrate, Munger, in connection with G.R. No.1445 of 2018, arising out of Mufassil P.S. Case No.160 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
