The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. The allegation is of commission of murder of the informant's father by several accused persons including this petitioner when the informant's father had gone to market for purchasing medicine along with his son (informant) and younger brother.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The petitioner is not named

Patna High Court CR. MISC. No.56184 of 2022(2) dt.17-01-2023 2/2 in F.I.R. rather during investigation his name transpired in this case on the basis of confessional statement of co-accused namely, Vivek Yadav. There is no specific overt-act of shot fire has been alleged against the petitioner. Moreover, several accused persons have already been granted bail by different coordinate bench of this court and the same has been annexed as Annexure-2 series. It is further submitted that the petitioner is languishing in judicial custody since 16.5.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Shankarpur P.S. Case No. 152 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., 1st Class, Madhepura.
