The petitioner seeks bail in Gopalpur (Rangra) P. S. Case No. 404 of 2018 instituted for the offence under Section(s) 302, 201, 120B/34 of the Indian Penal Code. Learned counsel for petitioner submits that petitioner is not named in the written report.

The written report has been filed by Choukidar alleging that one dead body was found lying beside the PCC road near Sitwel Dhar.

During investigating, the police recorded the statement of brother of deceased who told that he learnt about death of his brother from newspaper and Whats App. He has further stated that there was dispute between the deceased and

Patna High Court CR. MISC. No.53162 of 2019(2) dt.28-08-2019 2/2 Suman Singh brother-in-law of Naresh Singh regarding money. On account of such dispute, Naresh Singh, Kanchan Devi and Santosh Singh (petitioner) might have killed his brother.

As such, mere suspicion has been raised against this petitioner.

Petitioner is in custody since 29.5.2019 having clean antecedent..

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM 3rd Naugachia, Bhagalpur, in connection with Gopalpur (Rangra) P. S. Case No. 404 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
