JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Originally, the case was lodged under Sections 341, 323, 307, 386, 379, 504, 506/34 of the Indian Penal Code but after investigation, police submitted charge sheet for the offence punishable under Section 406 of the Indian Penal Code against the petitioner and the learned court below took cognizance for the above stated offence but the first information report itself says that Complaint Case No. 423 of 2014 had already been filed due to non-refund of rupees three lacs.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is

Patna High Court Cr.Misc. No.21089 of 2015 (2) dt.03-07-2015 allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Naugachia, Bhagalpur in Bihpur (Jhandapur) P.S. Case No. 276 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C.
