JUSTICE SUDHIR SINGH ORAL ORDER 02-03-2017 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with Bhagwan Bazar P.S. Case No. 101 of 2005, corresponding to S. Tr. No. 287 of 2006 for the offence instituted under Section 302/34 of the Indian Penal Code. The allegation against the petitioners is that they along with other accused persons in furtherance of common intention, committed murder of the deceased.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the

Patna High Court Cr.Misc. No.6583 of 2017 (3) dt.02-03-2017 2/2 petitioners. They have falsely been implicated in the present case. In course of investigation, the police has submitted final form against the petitioners. The same was accepted by the court below. The process has been issued against the petitioners at the stage of 319 of the Cr.P.C.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R. and process has been issued against the petitioners at the stage of 319 of the Cr.P.C. Considering the aforesaid facts and circumstances, let the petitioners, above named be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today, in connection with Bhagwan Bazar P.S. Case No. 101 of 2005, corresponding to S. Tr. No. 287 of 2006 on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 6th Additional District Judge, Saran at Chapra, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
