The petitioner, who is in custody, seeks bail in connection with Excise Case No. 317 of 2018 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Allegation against petitioner is of recovery of 487.500 litres of Nepalese Soffy from three motorcycles. It has been submitted on behalf of the petitioner that petitioner is quite innocent and has been falsely implicated in this case. Petitioner was apprehended while he was passing through road. Nothing incriminating material has been recovered from the conscious possession of the petitioner.

Patna High Court Cr.Misc. No.54493 of 2018(4) dt.04-10-2018 2/2 Petitioner has no criminal antecedent and he is in custody since 13.07.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, East Champaran, Motihari, in connection with Excise Case No. 317 of 2018.
