JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-07-2015 Heard learned counsel for the petitioner as well as learned counsel for the State.

In this application for anticipatory bail the petitioner apprehends his arrest for the offences punishable under sections 341, 323, 324, 307, 506, 504 and 34 of the I.P.C. Allegedly, when the informant was at his door along with his family members and when the informant asked from Santosh Ram about the quarrel he started abusing him and in the meantime the petitioner along with other co-accused having armed with Lathi-Farsa came there and also started assaulting him. Coaccused Santosh Ram inflicted Farsa blow over his head and when Manoj Ram and others tried to rescue him they were also assaulted by them by means of Lathi and Farsa.

Patna High Court Cr.Misc. No.21160 of 2015 (2) dt.23-07-2015 2/2 Submission is of false implication and that there is case and counter case. Against the petitioner there is no specific allegation. The injuries found on the person of the informant and Manoj Ram are simple in nature and as such the petitioner deserves sympathetic consideration, to which the learned A.P.P. opposes.

In the facts and circumstances as stated above, considering that against the petitioner there is no specific allegation for assaulting the informant and others and as such the petitioner in case of his arrest or surrender within one month from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. Sri Chandra Bir Singh, J.M. Gopalganj in Gopalpur P.S. Case No. 91 of 2014, G.R. No. 3018 of 2014, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
