The petitioner is languishing in custody since 10.5.2016 in a case registered for the offence punishable under sections 20(1)(c), 22, 27 of the N.D.P.S.Act.

Prosecution case is that on information that seven persons are indulged in selling Ganja, raid was laid and ten persons were apprehended. From the possession of the petitioner in two polythin bags 260 grams and 250 grams, total weighing 510 grams Ganja were recovered.

It is submitted by the learned counsel for the petitioner that the present quantity of recovery is of small quantity. Statement has been made in paragraph 3 of the application that the petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.26914 of 2016 (2) dt.29-06-2016 Learned counsel for the State does not controvert the small quantity of recovery from the petitioner. Considering recovery of small quantity of Ganja and the statement in paragraph 3 of the application that the petitioner has no criminal antecedent, let the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Patna in Special Case No. 17/2016 arising out of Rajiv Nagar P.S.Case No. 96/2016.
