JUSTICE ASHWANI KUMAR SINGH) 21-06-2022 In the present application preferred on behalf of the petitioner under Article 226 of the Constitution of India, a prayer has been made to cancel the birth certificate of the petitioner having registration no. B-2019-10-90097-025131 dated 15.07.2019.

It is submitted by the learned counsel for the petitioner that the aforesaid birth certificate was issued incorporating incorrect date of birth by mistake. It is further contended that the petitioner has already filed an application before the Registrar (Birth and Death), Patna Municipal

Patna High Court CWJC No.20056 of 2021(2) dt.21-06-2022 2/3 Corporation, Patna on 07.10.2021 as contained in Annexure-5 to this petition with a prayer to cancel the birth certificate stating therein all the facts and circumstances under which the birth certificate with incorrect entry of date of birth was issued in favour of the petitioner. The only grievance of the petitioner is that the Registrar (Birth & Death) is sitting tight over the representation of the petitioner.

Mr. Prasoon Sinha, learned counsel appearing for the Patna Municipal Corporation submitted that the representation of the petitioner as contained in Annexure-5 to the present application would be disposed of by way of a reasoned order as early as possible and preferably within a period of three months. Learned counsel for the petitioner contended that the petitioner would be satisfied if the representation as contained in Annexure-5 of the writ petition is disposed of expeditiously. Considering the nature of relief prayed for in the present application and the submissions advanced at the Bar, the writ petition is disposed of with a direction to the Registrar (Birth & Death), Patna Municiapal Corporation, Patna that in case the petitioner files a fresh representation along with a certified copy of the order passed by this Court in the present matter, the same should be disposed of in accordance with law
