JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-12-2021 Heard Mr. Jagjit Roshan, the learned counsel for the petitioner, Mr Pawan Kumar Choudhary, learned counsel for the Bihar University Service Commission and learned Advocate for the Patna University.
The petitioner is aggrieved by the decision of the respondents in not calling her for interview for the post of Associate Professor in the discipline of Statistics for which she had applied and was provisionally placed in the merit list having all requisite qualifications and degree. It appears from the records and from the statement made by the counsel for the parties that two posts have been kept for Unreserved (Female) category in subject Statistics. The petitioner, no doubt, is above the cut -of marks of seventy seven for the specific subject but she was not called for the interview for the reason that her name did not fall in such number which would be within three times the available vacancy.
The learned counsel for the Bihar University
Patna High Court CWJC No.19905 of 2021(2) dt.02-12-2021 3/3 Service Commission has made a categorical statement that nobody with lesser marks than the petitioner has been called for interview in the category of the petitioner, namely, in subject Statistics category UR(F).
Under the aforesaid circumstances, the petitioner has no reason to raise any grievance.
In case the aforesaid statement made by Mr. Choudhary, the learned counsel for the Bihar University Service Commission is found to be incorrect, it would be open for the petitioner to approach this Court again for redressal of her grievance.
The petition stand disposed of .
