The petitioner seeks bail in a case registered for the offences punishable under Sections 304(B), 201 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 14.08.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the informant alleges that her daughter was married to Ram Aadhar Shah in the year 2014 and after marriage a child was born. It is further alleged that thereafter the petitioner and the accused persons started demanding a motorcycle and Rs. One lakh for opening a shop and further on 03.10.2020, while her daughter was talking to her, the accused persons snatched her mobile and didn't allow her to talk and thereafter on 04.10.2020, the informant came

Patna High Court CR. MISC. No.68330 of 2021(2) dt.20-04-2022 2/2 to know that her daughter was seriously injured as she was stabbed by her husband and was killed by cutting her neck and her dead body was cremated.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, the informant is not an eye-witness to the occurrence. It is further submitted that petitioner is not related to the husband of the deceased and is a stranger to the family though petitioner is a villager but is not related in any manner to the family of the husband of the deceased.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent, charge-sheet has been submitted in the case and is not related to the husband of the deceased, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bathnaha P.S. Case No. 222 of 2020.
