Petitioner is apprehending his arrest in connection with Kundwa Chainpur P.S. Case No.170 of 2023, registered for the offence punishable u/s 363, 366, 504, 506, 34 of the IPC. 3.

The allegation against the petititioner is that he alongwith other co-accused persons kidnapped the informant. It is further alleged that one Pintu Kumar committed rape upon the informant.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence. He has been falsely implicated in this case. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for bail. 6.

Considering the aforesaid facts and circumstances and the fact that the statement of the victim was recorded under section 164 of Cr.P.C in which she supported the prosecution case, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. 7.

This application is accordingly dismissed.
