The petitioner apprehends his arrest in Sahajitpur P.S. Case No. 12 of 2017 instituted for the offence under Section(s) 30, 38, 41 of the Bihar Excise (Amendment) Act, 2016.

It is alleged that 16 bottles of foreign liquor each containing 750 ml were recovered from the Bathan of the petitioner.

The informant has mentioned in the written report that after preparation of the seizure list, no villager became ready to put signature on the seizure list.

In such circumstances, keeping in view the

Patna High Court Cr.Misc. No.13902 of 2017 (2) dt.24-03-2017 2/2 recovery of foreign liquor from the Bathan of the petitioner, this Court is not inclined to enlarge the petitioner on anticipatory bail. The prayer of the petitioner for anticipatory bail is rejected. The petitioner is directed to surrender before the Court below within a period of six weeks from today in connection with Sahajitpur P.S. Case No. 12 of 2017 and seek regular bail, which shall be considered, preferably on the same day and disposed off on its own merit without being prejudiced by the order of this Court.
