Upon superannuation from the service of the respondent- Bihar State Khadi and Village Industry Board, the petitioner was paid the retiral dues. However, the amount under the head gratuity on account of enhancement of ceiling in the sum of Rs. 20,000/- and odd could not be paid to him for which the writ petition is filed.

In the counter affidavit filed by respondent No.3 it is stated that on 07.07.2015 the remaining amount in the sum of Rs. 20,773/- has been sanctioned and paid to the petitioner. Considering the above, in my view, the writ
