The petitioner apprehends his arrest in Complaint Case No. 404 of 2015 instituted for the offence under Section (s) 193, 420 of the Indian Penal Code. It has been submitted that police after investigation in this case submitted final form. Thereafter, on the basis of protest petition, cognizance has been taken by the court below against this petitioner for the offence under Sections 193, 420 of the Indian Penal Code.

From the nature of allegation as levelled in the written report, this Court finds that this is a case of civil dispute

Patna High Court Cr.Misc. No.14003 of 2017 (2) dt.27-03-2017 2/2 for which civil remedy is also available.

From the order of the Sessions Judge also, it appears that no any specific allegation of overt act has been made except one that petitioner has sold the land of the complainant. In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Complaint Case No. 404 of 2015, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Purnea, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
