JUSTICE SANJAY PRIYA ORAL ORDER 17-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Gangta P.S. Case No. 56 of 2016 instituted for the offence under Sections 30(d) of Bihar Prohibition and Excise Act, 2016 and Section 2 (e)/13/S5(b)/18 of Bihar Mahua Flowers Act, 2016. It has been submitted on behalf of the petitioner that the petitioner is the owner of the vehicle from which 1000 kg. of Mahua flower and 90 tin of molasses were recovered. From the written report itself it appears that the petitioner was not present on the spot. The aforesaid articles have been recovered from the vehicle which was driven by one Santosh Kumar and accordingly seizure list was prepared. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Gangta P.S. Case No. 56 of 2016, G.R. No. 2375 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Munger, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
