The petitioner is apprehending his arrest in connection with Kishanganj P.S. Case No. 444 of 2016 registered for the offences punishable under Sections 307 and 379/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that though there is allegation against the petitioner that he fired which hit on the chick of the informant but the petitioner along with other accused persons has taken the informant/injured to the hospital and, as a matter of fact, there was dispute between them about money lending and due to that petitioner has been implicated by the informant.

Heard learned APP also, who has opposed the prayer

Patna High Court Cr.Misc. No.7202 of 2017 (2) dt.22-02-2017 2/2 for anticipatory bail of the petitioner.

Considering the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. However, petitioner should surrender and pray for regular bail, which shall be consider by the court below on the basis of the submission advanced before this Court as well as on the basis of materials available on record and disposed of the bail application without being prejudiced by this order.

With the above observations, this application is disposed of.
