2. The petitioner is in custody since 26.06.2019 in connection with Begusarai Muffasil P.S. Case No. 761 of 2018 for the offences alleged under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. It is submitted that the petitioner has been falsely implicated in connection with the murder of the informant's brother. It is submitted that admittedly the petitioner is not the main assailant rather the victim was fired upon by three coaccused persons namely Alok Singh, Bambam Singh and Kari Singh. The petitioner along with co-accused Bipin singh and Deepak Singh are said to have caught hold of the victim to facilitate the killing of the victim. Similarly situated aforesaid coaccused Deepak Singh and Bipin Singh have been granted bail by this Court in Cr. Misc. No. 15681 of 2019 and Cr. Misc. No. 37024 of 2019 respectively. The petitioner is accused in three prior
Patna High Court CR. MISC. No.55597 of 2019(4) dt.04-12-2019 2/2 cases in all of which he is on bail.

Be that as it may, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Begusarai Muffasil P.S. Case No. 761 of 2018, on the following conditions- (i) That one of the bailors shall be a close relative of the petitioner.
(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial. (iii) That the petitioner shall cooperate with the investigation, if not already concluded, and make himself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail. (iv) That the petitioner shall remain physically present in Court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned.
