JUSTICE SANJAY PRIYA ORAL ORDER 19-11-2018 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in Sikroul P. S. Case No. 50 of 2018 instituted for the offence under Section(s) 147,148, 149, 341, 323, 307, 302 and 504 of the Indian Penal Code. As per written report, there is specific allegation against this petitioner of assaulting the son of the informant by means of lathi on the head on account of which he sustained serious injury. Later on , he died in the hospital. Case diary has been received, wherein, the doctor has mentioned at para 37 of the case diary, that deceased died due to injuries on the head.

Learned counsel for the informant has appeared and opposed the prayer for bail.

Patna High Court Cr.Misc. No.54865 of 2018(3) dt.19-11-2018 2/2 Therefore, this Court is not inclined to grant bail to the petitioner at this stage. The prayer for bail of the petitioner stands rejected.

Trial Court is directed to expedite the trial and make efforts to conclude the same as early as possible preferably within a period of 9 months from the date of receipt of copy of this order.

Petitioner is given liberty to renew prayer for bail after nine months in the event the trial is not concluded. (Sanjay Priya, J) shyambihari/- U T
