The petitioner, in the present case, is seeking regular bail in connection with Barachatti P.S. Case No. 827 of 2017, registered for offences alleged under Sections 20 and 22 of the N.D.P.S. Act.
Learned counsel for the petitioner submits that even though there is an allegation that 500 gm of Ganja has been recovered from the possession of the petitioner, but the fact remains that nothing has been recovered from the conscious possession of the petitioner. He has got no criminal antecedent. No one appears on behalf of the State to oppose this

Considering the facts and circumstances of the case as also the quantity allegedly recovered from the possession of the petitioner which he claims not in his conscious possession, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cumSpecial Judge (NDPS Act), Gaya in connection with Barachatti P.S. Case No. 827 of 2017, subject to the conditions U/S 437(3) Cr.P.C.
